Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Pebby mobile application or website (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use Pebby.

The Service is operated by CREATIVE VLU SOLUTIONS SRL, a company incorporated under Romanian law (“Pebby”, “we”, “us”, or “our”).

You must be at least 18 years old to use Pebby. By using the Service, you confirm that you are 18 or older.

2. Description of Service

Pebby is a shared-care baby tracking application that helps multiple caregivers coordinate baby care activities — including feeding, sleep, and diaper tracking — through real-time synchronisation and automated handover summaries.

3. Account Registration

To use Pebby, you must create an account by providing accurate and complete information, including your name and email address. You are responsible for:

• Keeping your login credentials confidential
• All activity that occurs under your account
• Notifying us immediately at contact@marius.host if you suspect unauthorised access

You may only hold one account. We reserve the right to refuse registration or cancel accounts at our discretion.

4. Subscription and Payment

Pebby is available through a paid subscription only. There is no free tier. Access to the Service requires an active, paid subscription.

Billing
Subscriptions are billed on a recurring basis (monthly or annual, as selected). Payment is processed via Stripe, with subscription management handled by Adapty. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

Auto-renewal
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will receive a reminder before renewal where required by applicable law.

Cancellation
You may cancel your subscription at any time through the App Store (iOS) or Google Play Store (Android) settings. Cancellation takes effect at the end of the current billing period; you will retain access until then.

Refunds
Refund eligibility is governed by the applicable app store’s refund policy (Apple App Store or Google Play). We do not process refunds directly for purchases made through app stores. For billing issues not involving an app store, contact us at contact@marius.host.

Price changes
We may change subscription prices from time to time. We will give you at least 30 days’ notice of any price change by email or in-app notification. If you do not cancel before the price change takes effect, your continued subscription constitutes acceptance of the new price.

5. Shared-Care Groups

Pebby allows you to invite other adults to join a shared caregiving group so they can view and contribute to tracking logs in real time.

• You are responsible for ensuring that everyone you invite has consented to their data being shared within the group.
• Only invite people you know and trust. Group members can see all tracking data and your display name.
• You can remove any caregiver from your group at any time from within the app, immediately revoking their access.
• The group owner (the person who created the profile) controls group membership.

6. Acceptable Use

You agree not to:

• Use Pebby for any unlawful purpose or in violation of any applicable laws or regulations
• Enter false, misleading, or fraudulent data
• Share your account credentials with others (each caregiver must use their own account)
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of Pebby
• Resell, sublicense, or otherwise commercialise access to the Service
• Introduce malware, viruses, or any code that could harm the Service or its users
• Scrape, crawl, or systematically access the Service using automated means without our prior written consent
• Harass, abuse, or harm any other user of Pebby

7. Your Data

You retain ownership of the baby tracking data you enter into Pebby. By using the Service, you grant CREATIVE VLU SOLUTIONS SRL a limited, non-exclusive, worldwide licence to store, process, and display your data solely for the purpose of providing the Service to you and your caregiving group.

8. Intellectual Property

All rights in the Pebby application, website, brand, trademarks, logos, and content (excluding your tracking data) are owned by or licensed to CREATIVE VLU SOLUTIONS SRL. Nothing in these Terms grants you any rights in Pebby’s intellectual property other than the limited right to use the Service as described here.

9. Service Availability

We aim to keep Pebby available 24/7, but we do not guarantee uninterrupted access. We may suspend or limit the Service for maintenance, security updates, or reasons outside our control. We are not liable for any loss resulting from temporary unavailability.

We reserve the right to modify, discontinue, or change features of the Service at any time. For material changes that affect core functionality, we will provide reasonable notice.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be error-free, uninterrupted, secure, or that any defects will be corrected. Your use of Pebby is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by applicable law, CREATIVE VLU SOLUTIONS SRL, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of goodwill, arising from or related to your use of (or inability to use) the Service.

In any case, our total liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the total subscription fees you paid to us in the 12 months preceding the claim.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Termination

You may stop using Pebby and cancel your subscription at any time.

We may suspend or terminate your account immediately if we determine that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the security of the Service or other users. Where reasonably possible, we will notify you before taking such action.

Upon termination, your right to access the Service ceases. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) shall survive.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania.

If you are an EU consumer, you may also be entitled to bring proceedings in the courts of your country of residence under applicable EU consumer protection law.

14. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you at least 30 days in advance by email or via an in-app notice. The “Effective date” at the top of this page reflects the most recent version.

Your continued use of Pebby after the effective date of the updated Terms constitutes your acceptance of the new Terms.
